Overview

Residential and commercial conveyancing seem similar on the surface and in the broadest sense they are. But when it comes to the detail work, each process is very distinct. 

In commercial conveyancing – the transfer of offices, stores, warehouses, restaurants and entertainment venues, just to name a few of the possibilities – the parties transferring property are much more likely to be partnerships, companies or other business entities than individuals. To further complicate matters, the business is often being sold at the same time as the premises, bringing in the complications of compensating the seller for their client base and even the business’ name and reputation. 

In commercial conveyancing, things can be equally complex, for example, a residential property is an operating business, with anywhere from a handful to hundreds of leased tenants renting apartments or other living spaces. Similar care must be taken to ensure that both buyer and seller get what they actually want, without unfair detriment to those living in the property.
